Membership Terms and Conditions

Memberships and sales are subject to the following terms and conditions:

MEMBERSHIP AGREEMENT TERMS & CONDITIONS

 1. Failure to attend class does not signify or imply notification to cancel this agreement. 

2. Member’s failure to participate during the notification or program period does not relieve the obligation to pay the remaining Membership fees in full.

 3. Undersigned assumes all responsibility for any costs of collection, including but not limited to reasonable collection agency fees, court costs, reasonable attorney's fees, and applicable late charges that may be incurred for default payments. 

4. Business administrators may make any modifications in the class schedule as deemed necessary. Such modification does not relieve the undersigned of their payment obligations under any circumstances. 

5. Business administrators may close Fierce Fitness, LLC on national holidays, for the purpose of special events, and a period not exceeding four weeks per year for necessary maintenance and other purposes without affecting scheduled Membership payments. 

6. The Membership costs for ongoing fitness, kickboxing or martial arts programs are based on a 4 week month or a 48 week year.

 7. By entering into the agreement the undersigned grants Fierce Fitness, LLC permission to use photographs, videotapes, artwork or other likenesses of the Member for marketing, trade, publishing or any other lawful purpose.

 8. In consideration of the fitness, kickboxing or martial arts training obtained, Member agrees not to engage in fitness, kickboxing or martial arts teaching practices within a 25 mile radius of Fierce Fitness, LLC, or any other business associated with Fierce Fitness’ business administrators, without written permission, both while an active Member and for a period of 3 years following Membership cancellation. 

9. Full payment of Membership fees does not guarantee Belt certification by martial arts program administrators. 

10. Limited-duration or “TERM” program fees are non-cancelable, nonrefundable and non-transferable once the program has commenced. Ongoing membership fees are non-cancelable, nonrefundable and non-transferable except as stated herein. 

11. Member’s failure to attend scheduled classes relieves the obligation of Fierce Fitness, LLC to provide classes after the program end date. 

12. Undersigned authorizes the use of a disclosed e-mail address for billing purposes and acknowledges that e-mail text may include financial information pertaining to the Membership.  

ONGOING MEMBERSHIPS

 Cancellation of an ongoing Membership requires the completion of an Authorized Cancellation Form which can be obtained from the business office or online. The Membership is cancelled when all payments due within the specified notification period are paid in full. If a notification period is not specified, a minimum of 30 DAYS WRITTEN NOTICE is implied. There is no provision for temporary breaks in Membership. The Member retains Membership rights and privileges until the notification period expires. Cancelled Memberships may be reinstated at any time and are subject to a rejoining fee. Business administrators may raise the rate of ongoing Memberships providing advance notice equal to the cancellation notice stated herein

 WAIVER OF LIABILITY

 1. I HEREBY ACKNOWLEDGE AND AGREE THAT THE ACTIVITY OF FITNESS, KICKBOXING & MARTIAL ARTS TRAINING AND INSTRUCTION IS A CONTACT SPORT, which involves the risk of serious bodily injury and property damage participation in fitness, kickboxing or martial arts activities, events, practice sessions or other instruction. I ALSO ACKNOWLEDGE AND AGREE THAT MY PARTICIPATION IN FITNESS, KICKBOXING, MARTIAL ARTS TRAINING AND NUTRITION PROGRAMS AT FIERCE FITNESS, LCC IS TOTALLY VOLUNTARY, AND I EXPRESSLY ASSUME THE RISK AND RESPONSIBILITY FOR ANY INJURY RESULTING FROM MY PARTICIPATION. As a condition for my acceptance into any Fierce Fitness, LLC training program, I represent that my health condition is good and I am not suffering from any heart, lung or other bodily ailments and I have no physical limitations that would prevent me from safely participating in this activity. I understand that I should consult a physician before participating in any physical activity and/or nutrition program.

 2. Member has been advised that strict observance of the rules and regulations relative to martial arts self-defense training is mandated and includes the use of protective equipment. Fierce Fitness, LLC does not warrant that the protective equipment will completely eliminate the possibility of accident, injury, or death but may reduce the risk of accident, injury, or death.

 3. Physical contact will be used by employees of Fierce Fitness, LLC, other Members, and authorized individuals, as part of the course of instruction. Member has been advised of such fact and gives full consent to any physical contact as may be required or customary to fitness, kickboxing or martial arts training.

CONSUMER PRIVILEGES

 1. An ongoing membership agreement may be cancelled for any reason without penalty or further obligation within 3 days from the date of the agreement. Cancellation shall be made in writing to the business office and issued by dated mail. All money paid by you shall be refunded within 30 days of receipt of this notice of cancellation. However, Fierce Fitness may retain expenses incurred and the portion of the total price representing the services used and completed based on the hourly rate of $35, and any merchandise used. Down payments and registration fees are nonrefundable after the 3 days. 

2. If Member becomes disabled for at least three (3) months during the Membership terms, you have a right to an extension of the agreement. A letter must be submitted to the business office from the Member's physician explicitly stating medical condition and estimated time unable to participate in the fitness, kickboxing or martial arts program.

 3. You may cancel an ongoing membership agreement if the Member changes residence more than 25 miles from Fierce Fitness, LLC. Cancellation under this section requires written proof of new permanent address, phone number, and name and address of new employer. Cancellation is effective the date of move or upon official notification to the business office, whichever is later. A residence investigation may then be conducted. 

4. If Member becomes deceased, you shall be relieved of further obligation under this agreement not then due and owing.

5. All merchandise and store purchases are final. No refunds or credits.
